Introduction to Vicarious Liability

Under Vicarious liability, an employer will be held responsible for wrongs committed by an employee in the course of employment subject to following Conditions

  • Existence of an employer-employee relationship
  • Employee must have committed a wrongful act
  • The wrongful act must be committed during the course of an employment

It transfers liability from an employee (who has committed the tort) to an employer.

Example

Barry a client of Fresco bank has been defrauded by an employee who has now left Fresco bank, Barry may likely to succeed in a claim under employer’s liability against Fresco Bank.
